Terms of service

These Terms of Service (hereinafter "these Terms") set forth the conditions of use for the products and related services (hereinafter "the Service") provided through the official e-commerce site "Koai Official Online Store" (hereinafter "the Site") operated by Koai (hereinafter "we" or "the Brand").

All persons using the Site (hereinafter "Users") shall understand and agree to these Terms before using the Service.

Article 1 (Scope of Application and Amendments)

These Terms apply to all relationships between us and Users arising from the use of the Service. We may amend these Terms in accordance with Article 548-4 of the Civil Code when there are legal amendments, changes in social conditions, changes to the Service, or other reasonable necessity. When amending these Terms, we will notify Users in advance of the changes and the effective date by posting on the Site or by other means deemed appropriate by us.

Article 2 (Definitions)

In these Terms, the following terms have the meanings set forth below:

"Products" refers to clothing, related goods, and ancillary services sold by us through the Site.
"Users" refers to all individuals who browse the Site or purchase Products, regardless of whether they have registered as members.
"Members" refers to Users who have completed membership registration through the method prescribed by us.

Article 3 (Use by Minors)

Minors must obtain the consent of a parent or other legal guardian before using the Service. If a minor purchases a Product, we will deem that the consent of the legal guardian has been obtained.

Article 4 (Membership Registration)

Applicants for membership shall register true and accurate information in accordance with the method prescribed by us. We may decline membership registration in the following cases:

If the registration contains false information, errors, or omissions
If the applicant has previously been subject to suspension or other measures due to a violation of these Terms
Any other case where we reasonably determine registration to be inappropriate

If any registered information changes, Members shall promptly update such information through the method prescribed by us.

Article 5 (Management of IDs and Passwords)

Members are responsible for strictly managing their own IDs and passwords. We shall not be liable for any damages arising from unauthorized use of an ID or password by a third party, except in cases of intentional misconduct or gross negligence on our part.

Article 6 (Formation of Purchase Contracts)

Users place an order by selecting a Product on the Site and completing the purchase process. The purchase contract for the relevant Product is formed at the time we send the User a shipping confirmation email. However, if the contract cannot be completed due to insufficient stock or other reasons, we will promptly issue a refund. An order confirmation email does not constitute the formation of a contract.

Article 7 (Payment Methods)

Users shall pay for Products using one of the following methods as separately determined by us:

Credit card payment
Electronic payment services
Other methods designated by us

Any payment processing fees incurred shall be borne by the User.

Article 8 (Delivery and Receipt)

Forwarding service addresses may not be designated as delivery destinations.
We shall not be liable for delivery delays caused by natural disasters, traffic disruptions, logistics conditions, or other circumstances beyond our reasonable control.
If a Product is returned due to the User's absence resulting in the expiration of the delivery company's storage period, refusal of delivery, or other reasons attributable to the User, we may cancel the purchase contract.
In such cases, the User shall bear the round-trip shipping costs (actual cost) and any fees required for refund processing. We may settle the matter by refunding the product price already received minus such costs.
We shall not be liable for any damages arising from incorrect delivery addresses, extended absences, refusal of delivery, or other reasons attributable to the User.

Article 9 (Returns and Exchanges)

Customer-initiated returns are accepted only for items that are unused, unwashed, and returned with all tags, labels, and accessories intact, provided the User contacts us within 7 days of receiving the item.

Size exchanges are accepted once per order for items that are unused, unwashed, and returned with all tags, labels, and accessories intact, provided the User contacts us within 7 days of receiving the item.

Shipping costs for resending exchanged items will be covered by us. However, the return shipping cost is the responsibility of the User.

If a Product has an initial defect or does not match the order, we will arrange an exchange or refund, provided the User contacts us within 7 days of receiving the item. (Shipping costs for returns or exchanges due to defective items will be covered by us.)

Article 10 (Prohibited Activities)

Users shall not engage in any of the following activities:

Registering false information
Interfering with the operation of the Service
Unauthorized access or system tampering
Fraudulent use of credit cards
Purchasing Products for the purpose of resale (including purchasing large quantities at once or placing multiple orders with slightly altered names or addresses)
Any other activities we reasonably determine to be inappropriate (If we reasonably determine that a purchase is for resale, redistribution, or other commercial purposes, we may cancel the order, refuse future orders, or take other necessary measures.)

Article 11 (Intellectual Property Rights)

All copyrights, trademark rights, and other intellectual property rights in the content published on the Site belong to Koai or the respective rightful owners. Unauthorized use beyond the scope of personal use is strictly prohibited.

Article 12 (Handling of Personal Information)

We will handle Users' personal information appropriately in accordance with the separately established "Privacy Policy."

Article 13 (Suspension of Service)

We may suspend, interrupt, or terminate all or part of the Service without prior notice in cases of unavoidable circumstances such as system maintenance, technical failure, or disaster.

Article 14 (Disclaimer and Limitation of Liability)

We do not guarantee the completeness or accuracy of product information. In cases where we bear liability for damages to a User, except in cases of intentional misconduct or gross negligence on our part, our liability shall be limited to the purchase price of the Product under the relevant purchase contract. We shall not be liable for incidental, indirect, special, or consequential damages, or for lost profits.

Article 15 (Governing Law and Jurisdiction)

These Terms shall be governed by the laws of Japan. Any and all disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the district court or summary court with jurisdiction over the location of our principal place of business.
